Terms of Service

1. Acceptance of terms

By downloading, installing or using Lunexis VPN (the "App") or this website (together, the "Service"), you agree to be bound by these Terms of Service (the "Terms") and by our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Lunexis VPN is an Android application that routes your device's network traffic through encrypted tunnels using the Xray/V2Ray core and protocols including VMess, VLESS, Trojan and Shadowsocks. The Service is offered in two tiers: a free, advertising-supported tier with a daily time allowance, and a paid Premium tier purchased through Google Play.

A VPN changes how your traffic is routed and encrypted. It is not antivirus software, and it does not make you anonymous or immune from tracking by websites, accounts you log into, or your own device.

3. Eligibility

You must be at least 13 years old (16 in the European Economic Area) to use the Service. If you are below the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. You are responsible for ensuring that use of a VPN is lawful in your country — in some jurisdictions the use of VPN technology is restricted or prohibited.

4. Free tier and device identification

The free tier provides a limited amount of connection time per day (currently 30 minutes), which resets daily. Because the Service has no user accounts, the App generates an anonymous hashed device identifier ("HWID") to track the allowance for your device.

• You may not attempt to circumvent, reset, spoof or otherwise tamper with the HWID mechanism or the time allowance.
• The size of the free allowance may change at any time.
• Free-tier availability, server selection and speeds are not guaranteed.

5. Premium subscriptions

5.1 Billing

Premium is sold as an auto-renewing subscription through Google Play Billing. Payment is charged to your Google Play account at confirmation of purchase. Lunexis does not process, receive or store your payment card details.

5.2 Renewal

Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Your Google Play account is charged the renewal price within 24 hours prior to the end of the current period.

5.3 Cancellation

You can cancel at any time in the Google Play Store: profile icon → Payments & subscriptions → Subscriptions → Lunexis VPN → Cancel subscription. Cancellation stops future charges; you retain Premium features until the end of the period already paid for.

5.4 Refunds

Refunds are handled by Google Play under Google's refund policies. See our Refund Policy for details on how to request one.

5.5 Price changes

We may change subscription prices. Google Play will notify you of any price change and, where required, ask you to consent before the increase takes effect.

6. Advertising

The free tier is supported by advertisements served through Google AdMob. By using the free tier, you agree to the display of advertisements. Where required by law, you will be asked for consent regarding personalised advertising through Google's User Messaging Platform. Premium subscribers do not see ads. We are not responsible for the content of third-party advertisements or the sites they link to.

7. Acceptable use

You agree not to use the Service to:

• Violate any applicable law, regulation or third-party right;
• Send spam, bulk unsolicited messages, or engage in phishing;
• Distribute malware, ransomware, viruses or other harmful code;
• Conduct port scanning, denial-of-service attacks, network intrusion, credential stuffing or any unauthorised access to systems;
• Infringe copyright, trademarks, patents or trade secrets, including unlawful distribution of protected works;
• Access, produce or distribute child sexual abuse material or any content that exploits minors;
• Harass, threaten, defame or stalk any person;
• Engage in fraud, money laundering, or sale of illegal goods or services;
• Resell, sublicense, rent or commercially redistribute access to the Service;
• Reverse engineer, decompile or tamper with the App except to the extent that such restriction is prohibited by law;
• Overload, disrupt or abuse our infrastructure, including via automated scripts or excessive concurrent connections.

We may suspend or permanently block a device identifier that we reasonably believe is engaged in prohibited activity, without notice and without refund.

8. Disclaimer — no warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or available in any particular country; that any specific server, location or speed will be available; or that the Service will prevent all tracking, surveillance or interception. Servers may be added, changed or removed at any time.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNEXIS AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD 50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages; in those jurisdictions our liability is limited to the smallest extent permitted by law. Nothing in these Terms limits liability for fraud, gross negligence or death or personal injury caused by negligence.

10. Indemnification

You agree to indemnify and hold harmless Lunexis, its developers and affiliates from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

11. Intellectual property

The Lunexis name, logo, App design, website content and all related intellectual property are owned by Lunexis. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms.

The App incorporates third-party open-source components, including the Xray/V2Ray core (libv2ray). Those components remain subject to their respective open-source licences; attribution and licence texts are available in the App's "Open source licences" screen.

12. Third-party services

The Service relies on third parties including Google Play, Google AdMob, Firebase and Cloudflare. Your use of the App through Google Play is also subject to the Google Play Terms of Service. We are not responsible for the availability, policies or actions of these third parties.

13. Suspension and termination

You may stop using the Service at any time by uninstalling the App. We may suspend or terminate your access, block a device identifier, or discontinue the Service (in whole or in part) at any time, including if you breach these Terms or if operating the Service becomes impractical. Sections 8 through 11 survive termination.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the current version. Material changes will be communicated through the App or this website. Continued use after changes take effect constitutes acceptance of the revised Terms.

15. Governing law and disputes

These Terms are governed by the laws applicable at the place of the operator's principal establishment, without regard to conflict-of-law rules. You and Lunexis agree to attempt in good faith to resolve any dispute informally by contacting [email protected] before initiating formal proceedings. Nothing in this section deprives a consumer of the protection of the mandatory laws of their country of residence.
